Founding 10 — Program Rules

These Program Rules (the “Rules”) govern the Founding 10 Program(the “Program”), a limited launch promotion offered by CyberLuka. The Rules form part of, and should be read together with, our Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service.

1. Eligibility

You become a Founder if and only if CyberLuka issues you an invoice numbered 001 through 010 for a paid tier (Curiosity, Squad, or Team event). Invoice numbering is sequential and determined by the order in which our billing system records successful payments. There are exactly ten Founder slots, and once Invoice 010 is issued the Program closes.

The Free tier and Custom Event plans do not count toward the Founding 10. Vouchered or fully discounted orders that result in a non-zero invoice still count if a payment was processed.

2. The benefit

Each Founder is entitled to a permanent 50% discountoff the published list price of any paid tier (Curiosity, Squad, Team event) on every future purchase made under the Founder’s account, for as long as the account remains active and in good standing. The discount is applied automatically at checkout.

3. Scope — what “for life” means

“For life” means for the active life of the Founder’s CyberLuka account. The benefit ends when:

  • the account is closed (by you or by us);
  • the account is suspended or terminated for material breach of the Terms of Service;
  • the account is transferred to a different legal entity (the benefit is non-transferable, see section 7); or
  • the original qualifying invoice is refunded or charged back, and not re-paid within 30 days (see section 9).

The benefit does not depend on the continued availability of any individual product feature, the brand name “CyberLuka”, or the natural person currently operating CyberLuka.

4. List price reference

The discount is calculated as 50% of the published list price for the relevant tier in force at the time of the relevant purchase, not as a fixed euro amount. CyberLuka may change list prices from time to time; the Founder rate floats with the list price. Where we display the list price as a comparison or reduction, the price shown complies with Article 6a of Directive 98/6/EC (the 30-day-lowest-price rule).

5. Tier coverage and product changes

The Program covers the paid tiers offered at the time you became a Founder (Curiosity, Squad, Team event). If we rename or merge an existing paid tier into an equivalent successor tier, the Founder discount migrates to the successor at the same percentage. If a paid tier is discontinued without an equivalent successor, the Founder discount no longer applies to that tier from the date of discontinuation; this does not affect the discount on other paid tiers.

6. Stacking with other discounts

The Founder discount does not stack with vouchers, coupons, or other promotional discounts. Where more than one discount could apply to the same purchase, the discount most favourable to the Founder is applied and the others are not.

7. Transferability

The Founder benefit is tied to the Founder’s CyberLuka account and cannot be transferred to another account or another customer. If you transfer ownership or control of your account to a different legal entity (for example, on a corporate sale), the Founder benefit terminates on transfer.

8. One slot per legal entity

We award at most one Founder slot per legal entity. If we identify, in good faith, that two or more invoices among 001–010 were issued to the same legal entity (whether under different account names, brands, or apparent affiliates), we may consolidate them so the entity holds a single Founder slot, and the displaced invoice number is treated as a non-Founder invoice. The next chronological successful payment then takes the freed slot, so that ten distinct legal entities remain Founders.

9. Refunds and chargebacks

If the qualifying invoice (number 001–010) is later refunded or charged back, the Founder benefit is suspended with immediate effect. If the refunded amount is re-paid within 30 days, the benefit resumes. Otherwise, the slot retires — it is not reopened to another customer, and the total number of active Founders may therefore become fewer than ten.

10. Closure of the Program

The Program closes automatically upon issue of Invoice 010. CyberLuka may also close the Program at an earlier date in its discretion (for example, in the event of significant abuse), in which case any Founder slots already issued at that time remain valid on the terms set out here.

11. Amendments

CyberLuka may amend these Rules with at least 30 days’ prior notice by email to active Founders. If an amendment is materially adverse to a Founder, that Founder may terminate their account before the amendment takes effect and receive a pro-rata refund of any unused prepaid amounts; the Founder benefit then ends on termination. Non-material amendments (clarifications, typographical corrections, updates to contact details) take effect on publication.

12. Relationship to the Terms of Service

In the event of a conflict between these Rules and the Terms of Service, these Rules prevail with respect to the Founding 10 Program only. All other aspects of your use of the Service remain governed by the Terms of Service.
